THETRAVELPORTER PRIVACY POLICY

This Privacy Policy describes how we collect, use, process, and disclose your information, including personal information, in conjunction with your access to and use of theTravelPorter Platform or the Site and the payment services.

theTravelPorter (hereinafter referred to as "theTravelPorter", "we", "us" or "our") operates a platform and community marketplace that helps people form offline experiences and relationships directly with one another, where they can create, list, discover and book unique Activities around the world through our website ("Platform") or the Site as defined in our Terms of Use.

We take your right to privacy seriously and want you to feel comfortable using our Platform and Site. This Privacy Policy is intended to inform you about how we treat Personal Information and Data that we process about you. By using our Site and Platform it means that you agree with our Privacy Policy and Terms of Use.

Where the definition of a term does not appear in this Privacy Policy (such as "Listing", "Activity", "Content," "Services", “Site” etc.), you will find its definition in our Terms of Use (http://thetravelporter.com/terms-of-use).

WHAT TYPE OF INFORMATION DOES THETRAVELPORTER GATHER ABOUT ITS USERS?

1. Information that you give us

We receive, store and process information that you make available to us when accessing or using our Platform and Services. Examples include when you:

fill in any form on the Platform, such as when you Sign Up to our Newsletters or press Book Now and proceed with payment of an Activity;
access or use the Platform, such as to search for or post Activities, make or accept bookings, post comments or reviews;
communicate with theTravelPorter

This information (your Data and Personal Information) could be your name, e-mail address, phone number or other submissions that you make on this Site such as listing your activity preferences, your destinations and dates of travel and may contain your real name or other personally identifiable information and as a result hereof your Data may appear on the Site.

2. Like many platforms, we may also automatically receive general information that is contained in our server log files such as your IP address and cookie information.

3. theTravelPorter uses a third party payment provider called Stripe to ensure your personal and sensitive credit card information is securely stored. Your credit card details are NOT stored at theTravelPorter. Our Payment Service Processor Stripe is fully PCI compliant. All card information is truncated and passed through to Stripe for processing. theTravelPorter has no access to credit card information.

4. Your billing address that matches your credit card information. This information is required by our payment provider and our website host (Squarespace) in order to process your booking and payment.

5. theTravelPorter uses a pre-built website template by a third party called Squarespace which provides software as a service for website building and hosting. Please refer to this addendum to read about Squaresapce's Data Processing practises of how data is processed on our behalf.

HOW THETRAVELPORTER USES AND PROCESSES THE INFORMATION THAT YOU PROVIDE OR MAKE AVAILABLE

We use, store and process Information about you for the following general purposes:

to enable you to make Listings and purchase Activities;
to communicate with Vendors and Users regarding an Activity;
to send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;
to operate, protect, improve and optimize the Platform, theTravelPorter’s business, and our users' experience, such as to perform analytics, conduct research, personalize or otherwise customize your experience, and for advertising and marketing;
to help create and maintain a trusted and safer environment on the Platform and Services, such as fraud detection and prevention, conducting investigations and risk assessments, verifying the address of your Listings, verifying any identifications provided by you when required;
where we have your consent, to send you marketing and promotional messages and other information that may be of interest to you, including information about theTravelPorter or general promotions for partner campaigns and services.
to administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by theTravelPorter or our business partners; and
to comply with our legal obligations, resolve any disputes that we may have with any of our users, and enforce our agreements with third parties.

Your Personal Information may be disclosed as follows:

To the extent necessary to operate and manage referral and rewards programs.

The Activity Listing will always include information such as the name of the Vendor and other contact information (such as web and physical address) where necessary, your listing description, your calendar availability, your Activity profile photo(s) and other information that may be important for the User. Your public Listing page may also include aggregated demand information (such as number of page views over a period of time). Parts of your public Listing page may be displayed in other parts of the Platform (such as theTravelPorter blog) to other users for marketing purposes.
The Platform allows your public profile and Listing pages to be included in search engines. We do not control the practices of third-party search engines.
When you submit a request to book an Activity, your full name will become visible to the Vendor. We will not share your phone number unless there is a confirmed booking; if there is a confirmed booking, your phone number will become available to the Vendor, who may need to call you directly. We will NOT share your email address or your billing address. While the User and Vendor under these circumstances will exchange contact details, Users’ and Vendors’ billing and payout information will never be shared with another user.
When a User uses an Activity, we will ask the User to review the Activity. If you choose to provide a review, your review may be public on the Platform and our social media channels by use of your first name and nationality only.
We may distribute parts of the Platform (including your Listing) for display on sites operated by theTravelPorter’s business partners and affiliates. These could be for example, hotels and other accommodation owners or travel agencies (online and offline). If and when your Listings are displayed on a partner's site, information from your public profile page may also be displayed.
We may allow our related entities such as our subsidiaries, and their employees, to use and process your Personal Information in the same way and to the same extent that we are permitted to under this Privacy Policy. These related entities comply with the same obligations that we have to protect your Personal Information under this Privacy Policy.
You acknowledge, consent and agree that theTravelPorter may access, preserve and disclose your account information and Collective Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to (a) respond to claims asserted against theTravelPorter; (b) to comply with legal process; (c) to enforce and administer our agreements with users, such as the Terms of Use, (http://thetravelporter.com/terms-of-use), this Privacy Policy, and respective Vendor Agreement agreed with each Vendor; (d) for fraud prevention, risk assessment, investigation, customer support, product development and de-bugging purposes; or (e) to protect the rights, property or personal safety of theTravelPorter, its users or members of the public. We will use commercially reasonable efforts to notify users about law enforcement requests for their data unless:
- providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law; or
- based on information supplied by law enforcement, we, in our sole discretion, believe: (a) that providing notice could create a risk of injury or death to an individual or group of individuals, (b) that the case involves potential harm to minors, or (c) that harm or fraud could be directed to theTravelPorter, its Members, the Platform, or Services.

We may also publish, disclose and use Aggregated Information and non-personal information for industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.

If theTravelPorter undertakes or is involved in any merger, acquisition, reorganization, sale of assets or bankruptcy or insolvency event, then we may sell, transfer or share some or all of our assets, including your personal information and Listings. In this event, we will notify you beforehand.

Please also note that any reviews, forum postings and similar materials posted by you may continue to be publicly available on the SIte, at our discretion, in association with your first name, even after your have seized using theTravelPorter, as long as the storage and display of your Data and content serve a necessary and objective purpose. Please see our Terms of Use.

Please take note that no method of transmission over the Internet, and no method of storing electronic information, can be 100% secure. So, we cannot guarantee the absolute security of your transmissions to us and of your personal information (name, e-mail, telephone number) that we store.

If you reside in the EU or Japan, you may request in writing copies of your personal information held by us. We will provide you with a copy of the personal information held by us as soon as possible after receiving your request in writing. We may request proof of identification to verify your access request.

If your personal information that we hold is inaccurate, let us know and we will update the relevant information. You may also request the erasure of your personal information in accordance with the relevant data protection legislation. We will notify you within 30 days of your valid request about the relevant action taken.

YOUR PRIVACY WHEN YOU ACCESS THIRD-PARTY WEBSITES AND RESOURCES

Please note that we also partner with third-parties such as Mailchimp for the storage of e-mails and circulation of newsletters. We therefore encourage you to review Mailchimp’s Privacy Policy accordingly.

theTravelPorter will contain links to other websites not owned or controlled by theTravelPorter. We do not have any control over third party websites. These other websites may place their own cookies, web beacons or other files on your device, or collect and solicit Personal Information from you. They will have their own rules about the collection, use and disclosure of Personal Information. We encourage you to read the terms of use and privacy policies of the other websites that you visit.

PRIVACY POLICY CHANGES AND UPDATES

We may change this Privacy Policy at any time. If we make material changes to the Privacy Policy, we will notify you either by posting the changed Privacy Policy on the Site or by sending an email to you. We will also update the "Last Updated Date" at the top of this Privacy Policy.
